Equipment Hire Terms of Trade

1. Binding Agreement

1.1 This Agreement is between Riot Rentals (ABN: [40 873 628 243]) (“the Owner”) and the person or entity listed on the Booking Form (“the Hirer”).
1.2 By paying a deposit, taking possession of equipment, or clicking "I Accept" on our website, the Hirer agrees to be bound by these Terms of Trade.
1.3 This Agreement constitutes the entire agreement and supersedes all prior arrangements.
 

2. Hire Charges and Payment

2.1 Booking: A booking is only confirmed once a 10% deposit has been paid.
2.2 Hire Fee: The Hirer must pay the hire fee specified in the Quote/Invoice in full prior to or upon delivery/collection.
2.3 Security Bond: A refundable bond of $50 is required. The Owner reserves the right to deduct from this bond any late fees, cleaning fees, or damage costs. Bonds will be returned via the original payment method within [3-5] business days following a successful post-hire inspection.
2.4 Method of Payment: We accept [Credit Card, EFT, Cash, etc]. Credit card payments may incur a surcharge.
 

3. The Hire Period & Late Fees

3.1 Duration: The hire starts when the Hirer takes possession and ends when the equipment is returned to the Owner.
3.2 Late Returns: Time is of the essence. If the equipment is not returned by the "Return Time" specified:

  • A penalty of $50 per hour applies for the first 3 hours.

  • After 3 hours, a full additional day’s hire fee will be charged. 

3.3 Non-Return: Equipment not returned within 24 hours of the deadline without communication will be reported as stolen to the NSW Police.
3.4 Extension: Any request to extend the hire period must be made [6 hours] prior to the return time and is subject to availability.
 

4. Hirer’s Responsibilities & Equipment Use

4.1 Inspection: The Hirer must inspect the equipment upon receipt. Unless the Hirer notifies the Owner of a defect within 1 hour of taking possession, the equipment is deemed to be in good working order.
4.2 Standard of Care: The Hirer must:

  • Keep karaoke machines and electronic equipment under cover at all times and protected from weather, liquid, and smoke machines.

  • Ensure board games are used on clean surfaces and all pieces are accounted for before packing.

  • Not move the equipment from the delivery address without written consent. 

4.3 No Sub-Hiring: The Hirer must not re-hire, lend, or sell the equipment to any third party.

4.4 Supervision: The Hirer must ensure adult supervision is required at all times when equipment is in use around children, particularly regarding electrical components (karaoke) and small parts (board games).
 

5. Loss, Damage, and Insurance

5.1 Total Liability: The Hirer is responsible for all loss or damage to the equipment, regardless of how it occurs (including third-party damage or "Acts of God"), during the Hire Period.
5.2 Damage Costs:

  • Karaoke Systems: 

    • Minor Damage/Cleaning: If the equipment requires professional cleaning or minor repairs, the cost will be deducted from the Bond.

    • Major Damage/Replacement: If an item is damaged beyond repair or lost or stolen, the Hirer must pay the Current Full Retail Replacement Value plus any loss of income incurred by the Owner due to subsequent booking cancellations. This includes damage to microphones, screens or speakers. 

  • Board Games: 

    • Missing Pieces will result in a "Missing Part Fee" of $10 per piece or the full replacement of the game if it is rendered unplayable.

    • Minor Damage/Cleaning: If the equipment is returned in an excessively dirty condition (e.g water/liquid damage, marks, scratches) and requires cleaning or minor repairs, the cost will be deducted from the Bond.

    • Major Damage/Replacement: If an item is damaged beyond repair or lost or stolen, the Hirer must pay the Current Full Retail Replacement Value plus any loss of income incurred by the Owner due to subsequent booking cancellations. This includes damage to microphones, screens or speakers. 

5.3 Board Game Specifics: As many board games are "Out of Print" or "Collectors Editions," the Hirer acknowledges that losing a single unique piece may require the replacement of the entire game set.

 

6. Liability, Indemnity and ACL

6.1 Risk: The Hirer acknowledges that the use of electrical equipment and small board game parts carries inherent risks. Use is at the Hirer’s own risk.
6.2 Indemnity: To the full extent permitted by law, the Hirer indemnifies the Owner against all actions, claims, loss, damage, injury and demands (including legal costs) arising out of the use, misuse, or failure of the equipment.
6.3 Australian Consumer Law: Nothing in this agreement excludes, restricts, or modifies any guarantees or rights you have under the Competition and Consumer Act 2010 (Cth)
6.4 Limitation of Liability: To the extent permitted by law, the Owner’s liability is limited to the cost of re-supplying the hire services. The Owner is not liable for any consequential loss, including loss of profits or "spoiled party" damages.
 

7. Cancellation Policy

7.1 More than 14 days notice: Full refund of deposit.
7.2 7–14 days notice: Deposit is retained as a credit for a future booking.
7.3 Less than 7 days notice: Deposit is forfeited.
7.4 Force Majeure: If the Owner cannot fulfill the hire due to an event beyond their control (e.g., extreme weather, government lockdowns), the Owner may cancel the booking and provide a full refund of the hire fee, but is not liable for further damages.
 

8. Default and Debt Collection

8.1 If the Hirer fails to pay any invoice or damage claim, the Hirer will be liable for all costs of recovery, including debt collection agency fees, legal solicitor-client costs, and interest at a rate of 10% per annum.
 

9. Delivery & Collection

9.1 The Hirer must be present at the time of delivery/collection to sign the equipment condition report.
9.2 If [Business Name] is unable to deliver due to no one being present at the site, a re-delivery fee will apply.
 

10. Governing Law

10.1 This agreement is governed by the laws of NSW, Australia. Any disputes shall be settled in the courts of that jurisdiction.

4. Third-Party Links
  • Our site may contain links to third-party websites (such as YouTube for karaoke demos or board game instructional videos).

  • We are not responsible for the content or privacy practices of these external sites.
     

5. Privacy & Data Security
  • Your privacy is vital. Any personal information submitted via our Wix booking forms is handled in accordance with the Privacy Act 1988 (Cth).

  • We use secure payment gateways for all deposits and hire fees.
     

     

6. Limitation of Liability
  • To the extent permitted by law, Riot Rentals shall not be liable for any functional issues with the website that may result in booking delays.

     

  • Our total liability regarding your use of this website is limited to the cost of re-supplying our hire services.
     

     

7. Governing Law
  • These terms are governed by the laws of New South Wales (NSW), Australia.

     

  • Any disputes arising from the use of this website shall be settled in the courts of NSW.
